Birth Certificate Apostille – Simple New York Requirements

Getting an Apostille for a birth certificate depends on where the birth happened. Here is the quick guide so you know exactly what you need.

If the birth happened in New York City

(Manhattan, Brooklyn, Bronx, Queens, Staten Island)

To get an Apostille, you must have:

  • Long‑form birth certificate

  • Letter of Exemplification

Important:

  • The dates on both documents must match

  • Short‑form certificates are not accepted

  • Older certificates are not accepted

  • If you don’t have the Letter of Exemplification → NYC will reject the Apostille

If the birth happened outside NYC (any NY State county)

You can use:

  • A certificate from the local town/city clerk, OR

  • A certificate from New York State Department of Health (Albany)

Important:

  • Local certificates must be authenticated by the County Clerk (We handle this part for you)

  • Some counties require a new certificate

  • No Letter of Exemplification is needed for non‑NYC births

Where to order a correct certificate

For NYC births

Order from:

  • NYC Department of Health

For all other NY counties

Frequently Asked Questions – Birth Certificate Apostille (All States)

Do all U.S. birth certificates qualify for an apostille?

No. Every state has different rules. The certificate must meet your state’s requirements before the Secretary of State will accept it.

Why do apostille requirements differ by state?

Birth certificates are issued by state, county, or city/town Vital Records offices, and each office uses different formats and security features. Because of this, every state has its own apostille rules.

Do some states require recently issued birth certificates?

Yes. Example: Virginia requires the birth certificate to be issued within the last 12 months.

Do some states require notarization?

Yes. Example: New Hampshire requires the birth certificate to be notarized before it can be apostilled.

How do I know if my birth certificate is eligible?

The easiest way is to send us a picture of your document. We will check:
  • If it meets your state’s requirements
  • If it needs notarization
  • If it needs county certification
  • If it needs to be re‑issued

Why should I check eligibility before submitting to the Secretary of State?

If the document is not eligible, the Secretary of State will reject it, causing delays and extra cost. A quick review prevents this.

Can you evaluate my document before I come in?

Yes — and it’s free. Email a clear photo or scan to:
